Overview

The Plastic Waste Management Rules, 2016, as amended, and the Guidelines on Extended Producer Responsibility for Plastic Packaging, notified in February 2022, make producers, importers and brand owners (PIBOs) responsible for the plastic packaging they put on the Indian market.

PIBOs register with the Central Pollution Control Board (CPCB) on its plastic EPR portal, https://eprplastic.cpcb.gov.in, declare the packaging they place on the market by category, and meet recycling targets through EPR certificates from registered plastic waste processors. Brand owners also carry reuse and recycled-content obligations.

Who needs it

  • Producers of plastic packaging material.
  • Importers of plastic packaging, or of products in plastic packaging.
  • Brand owners, including e-commerce sellers and marketplaces selling under their own brand.
  • Plastic waste processors, who register as recyclers, co-processors or for waste-to-energy.

Process

  1. Map packaging to categories for every product and pack size.
  2. Work out quantities of packaging placed on the market, by year and state.
  3. Register as a PIBO on the CPCB portal, upload documents and pay the fee.
  4. Respond to CPCB queries until the registration is granted.
  5. Meet targets through EPR certificates from registered processors, plus reuse and recycled content for brand owners.
  6. File the annual return by 30 June and keep records for audit.

Note: CPCB revises the plastic EPR guidelines, targets and environmental-compensation rates from time to time. Check the latest CPCB notices before relying on older guidance.

Frequently asked questions

Who is a PIBO?

Producers, Importers and Brand Owners. A producer makes plastic packaging, an importer brings in plastic packaging or packaged goods, and a brand owner sells goods under their own brand in plastic packaging. Each registers in its own category.

Does an importer of packaged goods need plastic EPR?

Yes. The plastic packaging around imported goods counts, so importers of packaged products register as importers and carry targets for that packaging.

What are the plastic packaging categories?

Category I is rigid plastic packaging; Category II is flexible single-layer or multilayer packaging of more than one type of plastic, plus carry bags and sachets; Category III is multilayered packaging with at least one layer of plastic and one of another material; Category IV is compostable plastic packaging.

How are plastic EPR targets met?

Through EPR certificates from CPCB-registered plastic waste processors, by category. Brand owners also have reuse targets for rigid packaging and must use a minimum share of recycled plastic in their packaging.

When are returns due?

PIBOs file an annual return on the portal by 30 June for the previous financial year, showing packaging placed on the market and how targets were met.
